Terms and Conditions of Use

1. Acceptance of Terms
By accessing, registering on, or using the Synto AI platform (accessible at synto.ia.br), mobile applications, and any related services (collectively, the "Service"), operated by Synto Inteligencia Artificial Ltda ("Synto", "we", "us", or "our"), you agree to be bound by these Terms and Conditions of Use ("Terms"). If you do not agree to all of these Terms, you must not access or use the Service. These Terms constitute a legally binding agreement between you and Synto, governed by Brazilian law, particularly the Civil Code (Law No. 10,406/2002), the Consumer Protection Code (Law No. 8,078/1990), the Brazilian Internet Framework (Law No. 12,965/2014), and the General Data Protection Law (Law No. 13,709/2018 - LGPD).
2. Service Description
Synto AI is a platform that provides access to multiple artificial intelligence assistants designed to help users with various tasks, including but not limited to education, career development, personal organization, business support, creative projects, and general knowledge inquiries. The Service integrates multiple AI models from third-party providers and offers features such as: (a) Conversational AI assistants with specialized capabilities; (b) Document and content generation; (c) Code assistance and analysis; (d) Web search integration; (e) Various subscription tiers with different levels of access and functionality. The specific features and AI models available may vary by subscription plan and may be updated, modified, or discontinued at our discretion.
3. User Registration and Account
To access most features of the Service, you must create an account by providing accurate, current, and complete registration information. You are responsible for: (a) Maintaining the confidentiality of your login credentials and keeping your password secure; (b) All activities that occur under your account, whether or not authorized by you; (c) Immediately notifying us at suporte@synto.ai if you suspect unauthorized use of your account; (d) Ensuring that all information in your account remains accurate and up to date. You may not: (i) create multiple accounts for the same person; (ii) share your account credentials with third parties; (iii) use another person's account without their authorization; or (iv) create an account using false or misleading information. We reserve the right to suspend or terminate accounts that violate these conditions.
4. User Responsibilities
When using the Service, you agree to: (a) Comply with all applicable local, state, national, and international laws and regulations; (b) Not use the Service to generate, distribute, or promote illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable content; (c) Not attempt to reverse-engineer, decompile, disassemble, or discover the source code of any portion of the Service; (d) Not use automated tools, bots, or scripts to access the Service in a manner that exceeds reasonable use or circumvents rate limits; (e) Not attempt to gain unauthorized access to any part of the Service, other user accounts, or related systems and networks; (f) Not use the Service to generate content that infringes upon the intellectual property rights of third parties; (g) Not use the Service for mass generation of spam, misleading content, or disinformation; (h) Not use the Service to develop competing AI products or services by systematically extracting outputs; (i) Not use the Service in any way that could damage, disable, overburden, or impair the platform's infrastructure.
5. AI-Generated Content
You acknowledge and agree that: (a) AI-generated responses are produced by machine learning models and may contain inaccuracies, errors, biases, or outdated information; (b) Synto does not guarantee the accuracy, completeness, reliability, or suitability of any AI-generated content for any particular purpose; (c) AI-generated content should not be considered a substitute for professional advice, including but not limited to legal, medical, financial, or psychological advice; (d) You are solely responsible for evaluating, verifying, and determining the appropriateness of any AI-generated content before relying on or acting upon it; (e) AI-generated content does not represent the views, opinions, or endorsements of Synto; (f) Similar prompts may produce different responses due to the nature of AI models; (g) You should exercise critical judgment when using AI-generated content, especially for decisions that could have significant personal, financial, or legal consequences.
6. Intellectual Property
All intellectual property rights in the Service, including but not limited to the platform's software, design, logos, trademarks, trade names, user interface, and underlying technology, are owned by or licensed to Synto and are protected by Brazilian and international intellectual property laws. You may not: (a) Copy, modify, distribute, sell, or lease any part of the Service; (b) Use the Synto name, logo, or any trademarks without prior written consent; (c) Remove, alter, or obscure any copyright, trademark, or other proprietary notices. The Synto name, logo, and all related product and service names, designs, and slogans are trademarks of Synto Inteligencia Artificial Ltda. All other trademarks referenced in the Service are the property of their respective owners.
7. User Content and License
You retain ownership of any content you submit, upload, or create through the Service ("User Content"), including prompts, uploaded files, and other input data. By submitting User Content, you grant Synto a non-exclusive, worldwide, royalty-free license to use, process, store, and transmit your User Content solely for the purposes of: (a) Providing and operating the Service; (b) Improving and developing the Service (using only anonymized and aggregated data); (c) Complying with legal obligations. This license does not grant us the right to sell your User Content or to use identifiable User Content for marketing purposes without your separate consent. You represent and warrant that: (i) you own or have the necessary rights to the User Content you submit; and (ii) your User Content does not violate any third party's intellectual property or privacy rights.
8. Plans, Subscription and Payment
The Service offers both free and paid subscription plans. For paid plans: (a) Pricing and features for each plan are described on our website and may be updated from time to time; (b) Payment is processed through third-party payment providers and is due at the beginning of each billing cycle (monthly or annually, depending on your chosen plan); (c) All prices are displayed in Brazilian Reais (BRL) unless otherwise indicated, and include applicable taxes; (d) Subscriptions renew automatically at the end of each billing period unless canceled by you before the renewal date; (e) You may cancel your subscription at any time - cancellation will take effect at the end of the current billing period, and you will retain access until then; (f) Refunds are available within the first 7 days of a new subscription, in accordance with Article 49 of the Brazilian Consumer Protection Code (right of withdrawal for online purchases); (g) We reserve the right to modify pricing with at least 30 days advance notice; (h) Failure to pay may result in suspension or downgrade of your account to the free tier.
9. Limitation of Liability
To the maximum extent permitted by applicable law, including the Brazilian Consumer Protection Code: (a) Synto provides the Service on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory; (b) Synto does not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components; (c) Synto shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service; (d) Synto's total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you have paid to Synto in the twelve (12) months preceding the claim; (e) Synto is not liable for any losses, damages, or harm resulting from reliance on AI-generated content; (f) Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable Brazilian law, including mandatory consumer protection provisions.
10. Service Availability
We strive to maintain the Service available 24 hours a day, 7 days a week. However: (a) We do not guarantee uninterrupted access, as the Service may be subject to scheduled maintenance, updates, or unforeseen technical issues; (b) We may temporarily or permanently modify, suspend, or discontinue any part of the Service at our discretion, with reasonable notice when feasible; (c) We are not liable for any downtime, data loss, or service disruptions caused by factors beyond our reasonable control, including third-party service failures, internet connectivity issues, natural disasters, or force majeure events; (d) Specific AI models or features may be temporarily unavailable due to maintenance or updates by third-party AI providers; (e) Free tier users may experience reduced availability or slower response times during periods of high demand.
11. Termination and Suspension
We may suspend or terminate your access to the Service immediately and without prior notice if: (a) You violate any provision of these Terms; (b) We are required to do so by law or legal process; (c) We reasonably believe your account has been compromised; (d) Your conduct poses a risk of harm to other users, third parties, or our infrastructure; (e) You fail to pay subscription fees when due. You may terminate your account at any time through your account settings or by contacting us at suporte@synto.ai. Upon termination: (i) your right to access the Service ceases immediately; (ii) we may retain your data for the periods described in our Privacy Policy; (iii) provisions of these Terms that by their nature should survive termination will remain in effect, including intellectual property, limitation of liability, and dispute resolution provisions.
12. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the Federative Republic of Brazil. Any disputes arising from or related to these Terms or the Service shall be submitted to the jurisdiction of the courts of the domicile of the consumer (user), in accordance with Article 101, I, of the Consumer Protection Code (Law No. 8,078/1990). Before initiating legal proceedings, the parties agree to make good-faith efforts to resolve any dispute through direct negotiation. You may also submit complaints to consumer protection agencies (Procon) or to the consumer dispute resolution platform maintained by the Brazilian government (consumidor.gov.br).
13. Changes to Terms
We reserve the right to modify these Terms at any time. When we make material changes: (a) We will update the "Last updated" date at the top of these Terms; (b) We will notify you of significant changes through the platform or via email at least 30 days before they take effect; (c) Changes that expand your rights or reduce our obligations will take effect immediately; (d) Your continued use of the Service after the effective date of any changes constitutes acceptance of the revised Terms; (e) If you do not agree to the modified Terms, you must stop using the Service and may request account deletion. We encourage you to review these Terms periodically to stay informed of any updates.
